1. Limitation of liability. You accept to use the service "AS IS", and without warranties, express or implied, including, but not limited to, the implied warranties of merchantability or fitness for a particular use, purpose or application; timeliness; freedom from interruption; or any implied warranties arising from its usage. Under no circumstances shall we be liable for any punitive, indirect, incidental, special or consequential loss or damages, including loss of business, profits or goodwill. We shall not be liable to you by reason of delays or interruptions of service or transmissions, or failures of performance of our system, regardless of cause, including, but not limited to, those caused by hardware or software malfunction; governmental, or other regulatory action; acts of god; war, terrorism, or our intentional acts. You recognize that there may be delays or interruptions in the use of our system, including, for example, those caused intentionally by us for purposes of servicing the system. In no event shall our liability, regardless of the form of action and damages suffered by you, exceed the fees and fees paid by you to us in the month in which the action arose.
MDCodeWizard may amend, change, revise, add or modify the Agreement at any time. The most current Agreement will be posted to our Web site. You understand that this Agreement cannot be modified by any verbal statements or written amendments that you seek to make to the Agreement without written acceptance from MDCodeWizard.
2. No Advice and No Recommendations. You acknowledge that we do not and will not give medical coding advice or make recommendations. You agree that you are a self-directed medical coding professional and all claims entered are unsolicited and based on your own decisions or the decision of your duly authorized representative. You agree that neither MDCodeWizard nor any of its employees may be your duly authorized representative and that you will neither solicit nor rely upon MDCodeWizard or any of its employees for any such advice. You understand that you are solely responsible for all medical codes entered, including but not limited to ICD-9, CPT, HCPCS codes and modifiers, and will not hold MDCodeWizard or any of its employees liable for those decisions. You further understand that we do not and will not review the appropriateness or suitability for you of any transactions implemented or coding methodology employed in your Account. You hereby agree to hold MDCodeWizard and its officers, directors, employees, agents and affiliates harmless from any liability, financial or otherwise, or expense (including attorneys' fees and disbursements), as incurred, as a result of any losses or damages you may suffer with respect to any such decisions, instructions, transactions or strategies employed in your Account by you or your duly authorized representative, or as a result of any breach by you of any of the covenants, representations, acknowledgments or warranties herein.
3. Fees, Commissions and Account Minimums. You agree to pay the charges, taxes or other fees as set forth in our then-current fee schedule as applicable to the pricing structure of your account and the type of transactions and services you receive. MDCodeWizard’s Fee Schedule is available on our Web site. We may amend our Fee Schedule at any time by posting the changes to our Web site. You understand that MDCodeWizard may require a setup fee to open an Account. Fees are charged on a per month basis.

How We Protect Customer Information

To ensure your account is safely managed online and payments are scheduled properly, it is your responsibility to:
• Ensure there are available funds in your designated Online account(s) on the date for which you have scheduled a payment(s) to be made.
• Monitor your account activity and periodic statements on a regular basis and report any unauthorized or suspicious activity promptly to MDCodeWizard.com. If you think your online access codes have been compromised, you should change them immediately and contact us.
• Never reveal your online access codes to anyone.
• Do not leave your computer unattended while using MDCodeWizard Online Services. Once you have completed your changes, always sign off using the Logout button. For additional peace of mind, close your browser window before leaving your computer.
MDCodeWizard is committed to:
• Completing fund transfers and bill payments on time and according to your instructions
• Refunding late fees or charges if we fail to initiate your payments and transfers in a timely manner
While using the Web site, you may not:
• Post or transmit any unlawful, fraudulent, libelous, defamatory, obscene, pornographic, profane, threatening, abusive, hateful, offensive, or otherwise objectionable information of any kind, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, national or foreign law, including without limitation the U.S. export control laws and regulations
• Post or transmit any advertisements, solicitations, chain letters, pyramid schemes, investment opportunities or schemes or other unsolicited commercial communication (except as otherwise expressly permitted by Intuit) or engage in spamming or flooding
• Post or transmit any information or software which contains a virus, trojan horse, worm or other harmful component
• Post, publish, transmit, reproduce, distribute or in any way exploit any information, software or other material obtained through the Service for commercial purposes (other than as expressly permitted by the provider of such information, software or other material)
• Post, publish, transmit, reproduce, or distribute in any way, information, software or other material obtained through the Service which is protected by copyright, or other proprietary right, or derivative works with respect thereto, without obtaining permission of the copyright owner or right holder
• Upload, post, publish, reproduce, transmit or distribute in any way any component of the Service itself or derivative works with respect thereto, as the Service is copyrighted as a collective work under U.S. copyright laws.
